These General Terms and Conditions of Sale govern sales made on the website border-link.com, operated by BORDER LINK.

They define the rights and obligations of BORDER LINK and its customers in connection with the online sale of products, particularly toilet seats, bathroom accessories, and items for bathroom design.

Any order placed on the site implies prior acceptance of these General Terms and Conditions of Sale.

2. Purpose

The purpose of these terms and conditions is to define the conditions under which BORDER LINK offers its products for sale on its website.

BORDER LINK operates as an online retailer and sells products from various partners and suppliers.

BORDER LINK is not presented as the manufacturer or brand of the products offered on the site, unless expressly stated otherwise on the product page concerned.

The products offered are primarily intended for domestic use and bathroom design.

3. Products

The products available for sale are presented on the site with their main characteristics, dimensions, materials, colors, patterns, and other useful information where available.

Photographs and illustrations are provided for product representation purposes. Minor variations may exceptionally occur, particularly due to:

  • screen settings;

  • lighting conditions;

  • color reproduction;

  • normal variations between different manufacturing batches.

The essential characteristics of the product are those indicated on its product page at the time of order.

The customer is invited to carefully check the dimensions, shape, fixing characteristics, and any compatibility indications before ordering a toilet seat or any other item requiring installation.

4. Availability

Products are offered while stocks last.

When a product is no longer available, BORDER LINK may temporarily or permanently remove the product from the site.

If a product ordered exceptionally becomes unavailable after the order has been validated, the customer will be informed as soon as possible.

When the order cannot be executed due to this unavailability, the customer may obtain a refund of the corresponding amounts in accordance with applicable regulations.

5. Price

Prices are indicated in euros (€).

The applicable prices are those displayed on the site at the time of order validation.

Prices include applicable taxes when they are due and indicated in accordance with regulations.

Delivery costs are indicated before the final validation of the order.

For orders:

  • under €39: €3.90 delivery fees;

  • from €39: free standard delivery.

The total amount to be paid is presented to the customer before the final confirmation of the order.

No additional fees will be charged after order validation if they have not been clearly presented to the customer beforehand.

6. Order

To place an order, the customer selects the desired products, adds them to their cart, then fills in the necessary information for delivery and payment.

Before definitively confirming their purchase, the customer can check:

  • the selected products;

  • the quantities;

  • the price;

  • delivery fees;

  • delivery information;

  • the total amount of the order.

The customer can correct any errors before final validation.

The order becomes final after order confirmation and payment validation.

7. Order Confirmation

After order validation, a confirmation email may be sent to the address indicated by the customer.

This confirmation includes the essential information relating to the order.

It is the customer's responsibility to check the information provided and to contact BORDER LINK quickly in case of error.

Electronic communications relating to the order may be retained by BORDER LINK to allow tracking of the contractual relationship.

8. Payment

Payment methods available on the site may include:

  • Mastercard;

  • American Express;

  • Apple Pay;

  • PayPal Wallet;

  • Klarna.

The availability of a payment method may depend on the customer's situation, their device, their bank, or the payment provider's terms and conditions.

Payment is processed by the relevant payment providers.

BORDER LINK does not ask the customer to provide full credit card details by email or phone.

An order may be put on hold if payment has not been properly authorized or confirmed.

9. Delivery

Orders are shipped to the address indicated by the customer during the order process.

The applicable delivery conditions, fees, and times are detailed in our Delivery Policy.

For eligible orders, standard delivery is free from €39.

For orders under €39, standard delivery fees are €3.90.

The delivery times communicated on the site constitute the usual times applicable to the order concerned.

In case of delivery delay, the consumer's rights provided by applicable regulations remain fully applicable.

Where no particular deadline has been agreed upon, European regulations notably provide that delivery must take place no later than 30 days after the conclusion of the contract, subject to the provisions applicable to the contract concerned.

10. Delivery Address

The customer is responsible for the accuracy of the information provided during the order.

Any address error must be reported as soon as possible.

If the order has not yet been shipped, BORDER LINK will do its best to accommodate a modification request.

Once the order has been handed over to the carrier, an address modification cannot always be guaranteed.

11. Receipt of Products

The customer is invited to check the apparent condition of the package and the product upon receipt.

In case of visible damage, it is recommended to take photographs of the package and the product and to contact BORDER LINK promptly.

However, the absence of a reservation made with the carrier does not deprive the consumer of the rights granted to them by applicable legal guarantees.

12. Right of Withdrawal

In accordance with the European and French rules applicable to distance contracts, the consumer generally has a period of 14 calendar days to exercise their right of withdrawal from the receipt of the goods, without having to justify their decision.

The customer must inform BORDER LINK of their decision to withdraw before the expiry of this period.

After informing BORDER LINK of their decision, the customer must return the product within the applicable legal period.

The product must only be handled to the extent necessary to ascertain its nature, characteristics, and proper functioning.

When the handling goes beyond what is necessary for this verification and results in a depreciation of the product, the consumer's liability may be engaged under the conditions provided by law.

13. Return Shipping Costs

In the case of a valid exercise of the right of withdrawal due to a change of mind, the direct return costs may be borne by the customer if they were informed of this before the sale was concluded.

When a product is defective, non-compliant, or damaged and the situation falls under the responsibility of BORDER LINK or a legal warranty, the applicable costs are covered in accordance with regulations.

14. Refund

In the event of a valid exercise of the right of withdrawal, BORDER LINK will refund the amounts due in accordance with applicable regulations.

The refund notably includes the price of the product and, when required by law, the standard delivery costs initially paid by the customer.

If the customer chose a more expensive delivery method than the standard method offered, the corresponding additional cost for this choice may not be refunded.

The refund is generally made using the same payment method as that used during the order, unless expressly agreed otherwise.

The refund may be deferred under the conditions provided by law, notably until the product is recovered or until receipt of proof of shipment of the returned product.

15. Legal Guarantees

Products sold to consumers benefit from applicable legal guarantees, particularly the legal guarantee of conformity and the guarantee against hidden defects, under the conditions provided by French and European regulations.

The legal guarantee of conformity applies, in particular, when a product does not correspond to the contractual description, does not possess the expected qualities, or is not suitable for the use normally expected of a product of the same type.

In the European Union, consumers benefit from a minimum legal guarantee of two years for new goods. In the event of a defect covered by this guarantee, the seller must, under legal conditions, repair or replace the product, or, when this is not possible or appropriate, grant a price reduction or a refund.

These legal guarantees are independent of any commercial warranty that may be offered.

16. Product Installation and Use

The customer must adhere to:

  • the indicated dimensions;

  • assembly instructions;

  • the product's technical specifications;

  • indicated usage limits;

  • any safety recommendations.

BORDER LINK cannot be held responsible for damage resulting from incorrect installation, product modification, or use clearly contrary to the instructions provided, without prejudice to the consumer's mandatory rights under legal guarantees.

The customer must notably verify that the chosen product matches their toilet's configuration before any definitive installation.

17. Damaged or Non-Compliant Products

If the customer receives:

  • a product different from the one ordered;

  • an incomplete product;

  • a damaged product;

  • a product with a defect;

  • a product that does not conform to the contractual characteristics;

they must contact BORDER LINK as soon as possible.

The customer may be asked to provide photographs or information to help identify the problem.

These elements facilitate the processing of the request but do not limit the consumer's legal rights.

When a problem falls under the seller's responsibility or a legal guarantee, BORDER LINK covers the necessary costs in accordance with applicable regulations.

18. Liability

BORDER LINK employs reasonable means to ensure the accessibility and proper functioning of the site.

However, the site may be temporarily inaccessible due to, in particular:

  • maintenance operations;

  • technical problems;

  • a network interruption;

  • an event beyond BORDER LINK's control.

BORDER LINK cannot be held responsible for damages resulting directly from incorrect use of the products by the customer, particularly from installation that does not comply with the instructions.

This limitation does not apply where BORDER LINK's liability cannot legally be excluded or limited.

19. Intellectual Property

The texts, photographs, illustrations, graphic elements, logos, layouts, and other content present on the site are protected by applicable intellectual property rules.

Unless prior authorization is granted, any unauthorized reproduction, representation, adaptation, distribution, or exploitation of all or part of the site may constitute a violation of applicable rights.
